Terms of Service

These Terms of Service ("Terms") govern your access to and use of fiddleo.co and the Fiddleo application (together, the "Service"), operated by Brandon L Pickett LLC, d/b/a Fiddleo ("Fiddleo," "we," "us"). By creating an account or otherwise using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

1. The Service

Fiddleo helps you research, draft, humanize, score, and publish content, and generates content using third-party AI models. Fiddleo is a tool — it does not guarantee any particular search ranking, traffic outcome, or business result from content produced using the Service.

2. Accounts

You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.

3. Subscriptions and Billing

Paid plans are billed in advance on a recurring basis through Stripe. Unless stated otherwise at signup, subscriptions renew automatically until cancelled. You can cancel at any time from your account settings; cancellation takes effect at the end of your current billing period, and we do not provide refunds for partial periods except where required by law. We may change our pricing with reasonable advance notice.

4. Acceptable Use

You agree not to use the Service to:

• Generate or publish content that is unlawful, defamatory, fraudulent, or infringes a third party's intellectual property or other rights;
• Generate content impersonating a real person or organization without authorization, or spam/deceptive content designed to manipulate search or AI systems in violation of a platform's stated policies;
• Interfere with or disrupt the integrity or performance of the Service;
• Attempt to gain unauthorized access to the Service or its related systems; or
• Use the Service in violation of any applicable law.

We may suspend or terminate accounts that violate this section.

5. Your Content

You retain ownership of the keywords, briefs, and content you input into or generate through the Service ("Your Content"). You grant Fiddleo a limited license to host, process, and transmit Your Content solely as needed to provide the Service to you, including sending it to any publishing destination you configure.

You are responsible for reviewing AI-generated content before publishing it. AI-generated content can contain factual errors, and you are solely responsible for verifying accuracy, securing any necessary rights for referenced material, and complying with the terms of any platform you publish to.

6. Our Intellectual Property

The Service itself — including its software, design, and branding — is owned by Fiddleo and protected by intellectual property laws. These Terms do not grant you any rights to Fiddleo's trademarks, logos, or underlying technology beyond what's needed to use the Service as intended.

7. Third-Party Services

The Service relies on and integrates with third-party providers (including AI model providers, payment processors, and any publishing destination you connect). We are not responsible for the availability, accuracy, or practices of third-party services, and your use of them is subject to their own terms.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI-GENERATED CONTENT WILL BE ACCURATE, ERROR-FREE, OR SUITABLE FOR ANY PARTICULAR PURPOSE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIDDLEO AND ITS OWNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

10. Indemnification

You agree to indemnify and hold Fiddleo harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service in violation of these Terms, or your violation of any law or third-party right.

11. Termination

You may stop using the Service and cancel your account at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we discontinue the Service, with notice where reasonably practicable.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Colorado, and you consent to personal jurisdiction there.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you directly. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
